3. Use of Services

4. Project Engagement
Before commencing any work, the exact scope of the project will be defined and agreed upon by both parties. Timelines are estimations and may vary based on project complexity and unforeseen technical challenges. Prompt communication from the client is required to maintain steady progress and meet deadlines.
5. Payments & Billing
Pricing for services will be explicitly agreed upon before the start of any project. Depending on the scale of the engagement, upfront payments or milestone-based payments may apply. Delays in completing scheduled payments may result in the suspension of services or delays in project delivery.
6. Intellectual Property
Upon final payment and completion of the project, ownership of the final deliverables generally transfers to the client, unless otherwise agreed. However, Lunex retains full rights to any internal frameworks, proprietary tools, or underlying codebases used to construct the solution. Unless explicitly restricted by an NDA, Lunex reserves the right to showcase the completed work in our portfolio.
7. Limitation of Liability
Lunex strives for engineering excellence, but we do not warrant that our services will be entirely error-free. Lunex shall not be liable for any indirect, incidental, consequential, or punitive damages arising out of your use or inability to use our services or deliverables.
8. Service Availability
We aim for high availability, but we provide no absolute guarantee of uninterrupted service for managed systems. Scheduled maintenance, updates, or unexpected downtime may occur to ensure the long-term health of our infrastructure.
9. Termination
Either party may terminate a project or service agreement with formal written notice. Upon termination, all pending dues for work already completed must be cleared immediately by the client.
10. Changes to Terms
Lunex reserves the right to modify or replace these Terms of Service at any time. Significant changes will be communicated, and continued use of our services constitutes acceptance of the updated terms.
